To negotiate a waste contract, give providers the same service brief and compare the total payable cost with the terms attached. A lower lift price may not be a better offer if rental, weight allowances, access fees or cancellation conditions differ.
Before you negotiate
- List every container, stream, location and collection frequency.
- Record recent actual collections, missed visits and seasonal changes.
- Reconcile invoices with the contract and written variations.
- Identify your notice deadline before arranging competing quotes.
The waste audit checklist helps assemble that evidence. An unchanged contract is not proof that you are overpaying; comparable current offers establish the available alternatives.
Key contract clauses to review
| Clause | Ask for |
|---|---|
| Price changes | The exact index, calculation date, adjustment frequency, additional levy treatment and notification process. |
| Renewal | Initial term, next term, notice deadline, accepted notice method and acknowledgement. |
| Early exit | A worked calculation of charges and the rights that apply after service failures. |
| Contamination | The material specification, assessment process, evidence, charges and dispute route. |
| Equipment | Ownership, rental, maintenance, damage, removal and return obligations. |
Negotiate service as well as price
Put collection windows, missed-service escalation and seasonal schedule changes in writing. Ask whether reporting contains actual weights or estimates. Keep specialist-stream requirements unchanged while comparing commercial terms.
Use a common annual scenario: scheduled collections multiplied by the quoted rate, plus recurring fees, applicable disposal charges and one-off costs. Show uncertain items separately and compare GST consistently. Do not count a hypothetical future rebate as a guaranteed discount.
Know when to get advice
ACCC guidance describes protections against unfair terms in eligible standard form contracts, including the post-9 November 2023 small-business thresholds. Only a court can finally decide whether a term is unfair. Do not assume a renewal or exit fee is enforceable or void from its label alone. Australian Competition and Consumer Commission: Contracts.
Before signing
Ask for all agreed changes in the final contract, check the quote's validity, and confirm who is authorised to accept it. If switching, coordinate container delivery and removal with a confirmed first collection. The tender guide provides the next step for larger or multi-site requirements.
